Prize draw rules — The Green

Article 1 — Organiser

YLC NETWORK FZC, a free zone company incorporated under the laws of the United Arab Emirates, with its registered office at Business Centre, Sharjah Publishing City Free Zone, Sharjah, Émirats arabes unis, holding commercial licence no. 300641 issued by the Sharjah Publishing City Free Zone Authority (hereinafter "the Organiser"), organises a free monthly prize draw with no purchase necessary.

The promotion is accessible from thegreen.today and its signed-in area, under the trade names Versus, Flush, Sprig and iClutch, which designate four environments of a single account.

Article 2 — Participation

Participation is open to any natural person of legal age holding an account on the service, excluding persons involved in organising the promotion.

Participation is free and requires no purchase. Creating an account requires a valid email address and nothing else.

One entry per person. Multiple accounts held by the same person may be suspended, and any tickets arising from them cancelled.

Article 3 — Greens

Greens are a game unit with no monetary value. They cannot be bought, sold, transferred outside the service, or converted into any sum of money.

They are earned by playing: by taking on the daily challenges offered in the four environments, and by playing the games of chance described in article 4.

A single day earns at most twenty (20) greens through play, across all environments and all games. The four environments are four ways to fill one day, not four allowances. This cap is enforced by the service itself, which credits nothing beyond it.

Greens received from another participant at the end of a duel are governed by article 5 and are not counted towards this cap, which bounds what the service creates and not what participants exchange between themselves.

Article 4 — Games of chance

The service offers three games of chance: a scratch card, a lottery and a slot machine.

Participation in each of these games is limited to one (1) free play per day per person. There is no way to wager, to pay to play again, or to buy an additional play, in any form whatsoever. This limit is enforced by the service itself, which refuses the second play of the day.

The outcome of each play is drawn by the Organiser's server. The participant's browser does not know the outcome before it is determined and cannot influence it.

Any winnings from these games are greens, and they count towards the daily cap in article 3. These games give no ticket and do not improve the odds in the draw in any way.

Article 5 — Duels between participants

A participant may challenge another participant to a duel on the same game board, staking a number of greens between one (1) and five (5). The opponent who accepts stakes the same number. The winner receives the greens staked by both participants.

A duel creates no greens: it moves them from one account to another. The sum of all green movements arising from duels is zero, and the Organiser pays out nothing on that occasion.

No stake can be paid for or topped up with money, greens not being purchasable. A duel is not a bet in the sense of gambling: nothing staked was acquired against payment, and nothing won can be converted into money.

A duel gives no ticket. It may make the cap in article 7 easier to reach within the month, never higher.

Article 6 — How a ticket is obtained

Funding an environmental project from the list offered in the service spends one hundred (100) greens, records an impact and gives one (1) ticket for the current month's draw.

That is the only act that gives a ticket.

Other actions in the service produce real environmental impacts without giving a ticket: in particular, a plastic bottle pulled out of the ocean when a post reaches its heart threshold, or when a plant reaches its drop threshold. Those impacts are funded by the Organiser, require no spending of greens, and do not enter the draw.

Article 7 — Five tickets a month, for everyone

The number of tickets is capped at five (5) per calendar month per person, across all environments.

No purchase, no subscription and no payment of any kind gives an additional ticket or improves the odds. The subscription offered by the service doubles the rate at which greens are earned through play: it makes the cap easier to reach within the month, never higher.

The same applies to duels: winning greens from another participant may make the cap easier to reach, never higher.

This cap is enforced by the service itself, which refuses the sixth ticket.

Article 8 — Prizes

The monthly prize pool consists of 190 Amazon.fr gift cards, for a total value of €2,625 per month, broken down as follows: 100 cards of €5, 50 cards of €10, 25 cards of €25, 10 cards of €50 and 5 cards of €100.

The prize pool is fixed when each draw opens and is not changed during the month. A prize may not be exchanged, refunded, or replaced by its cash value.

Prizes are delivered by email, through a gift card issuing provider. A participant whose email address is invalid or unreachable cannot be served.

Article 9 — Date and conduct of the draw

A month's draw is carried out on the first day of the following month, once the period has elapsed. A month in progress cannot be drawn.

The draw is carried out by an automated process among all valid tickets of the period. A ticket can win only once.

The scarcest prizes are allocated first, so that at equal chance the rarest prize has the same chance of reaching someone.

Article 10 — Verifiability of the draw

The Organiser retains the seed of the pseudo-random generator used for each draw.

That seed, together with the list of tickets for the period, makes it possible to replay the draw and obtain the same results. It is provided free of charge to anyone who requests it at the address given in article 16, within thirty (30) days of the request.

This undertaking is binding on the Organiser: "we drew lots" is not a verifiable statement, a retained seed is.

Article 11 — Notification and delivery of prizes

Winners are informed in their signed-in area, where the prize, the month and the winning ticket number are shown.

The prize is sent to the email address associated with the account. If delivery fails, the Organiser sends it again; a prize still undelivered after thirty (30) days is deemed forfeited.

The Organiser cannot be held liable for an email address that is wrong, full or unreachable.

Article 12 — Fraud

Any attempt to obtain greens other than by playing under the conditions set out in articles 3 to 5 — multiple accounts, automation, falsification of the data sent by a third-party service, collusion between participants to transfer greens through arranged duels — results in the cancellation of the tickets concerned and may result in the suspension of the account.

Challenge results are recomputed on the server. No value sent by the browser is accepted as a result, and the outcomes of the games of chance are drawn by the server.

Article 13 — Personal data

The data processed for the purposes of the promotion is that necessary for participation and for delivering prizes: email address, display name, tickets and winnings.

It is kept for as long as the promotion and the legal obligations arising from it require. The rights of access, rectification, erasure, objection and portability are exercised at the address given in article 16.

The service's privacy policy sets out all processing in full.

Article 14 — Amendment and cancellation

The Organiser may amend, suspend or cancel the promotion if circumstances so require, without incurring liability on that account.

An amendment gives rise to updated rules, published at the same address. Tickets already earned remain valid for the current period.

Article 15 — Acceptance

Participation entails full and unreserved acceptance of these rules.

The rules can be consulted free of charge and at any time on thegreen.today, and are sent free of charge to anyone who requests them at the address given in article 16.

Article 16 — Governing law and complaints

As the Organiser's registered office is located outside France, submitting this promotion to French law is a voluntary choice made by the Organiser for this promotion. These rules are governed by French law.

Any complaint relating to the draw must be sent to bonjour@thegreen.today, or by post to the registered office given in article 1, within thirty (30) days of the draw concerned. The Organiser replies within thirty (30) days.

Failing an amicable resolution, the participant may refer the matter to the European Consumer Centre of their country of residence, as well as to the national consumer protection authority they fall under. These remedies exist without any prior step by the Organiser.

Article 17 — Governing language

These rules are drafted in French. The English version published at the same address is a courtesy translation, provided for understanding.

In the event of any discrepancy between the two versions, the French version prevails. Article 16 submits this promotion to French law by the Organiser's own choice, and rules that submit to a law are read in the language of that law.

This is the inverse of the rule that governs the terms of service and the privacy policy, which are drafted in English and governed by the law of the United Arab Emirates: each text is authoritative in the language of the law it answers to.
